Sandestin Resort Basic Information:

1.  Sandestin has a master association:  All sandestin property owners belong to the master association and must pay association fees to this association.
2.  Most individual communities or condo projects within Sandestin have their own assocation with additional fees:  The fees vary in each individual community based on health of the assocation, ammenities, insurance expenses, landscaping, etc.
3.  There is a .5% new buyer fee for all transactions in Sandestin.  Some of the individual communities within Sandestin may have additional new buyer fees. Properties in the Village of Baytowne Wharf have an additional 1% new buyer fee.  Making the total 1.5%
4.  Sandestin On-Site Rental:  Sandestin does have an on-site rental company.  In most cases you are not required to use the on-site rental company but they do a good job and charge accordingly

WHY DO YOU NEED A REALTOR WHEN BUYING AND SELLING FORECLOSURES AND SHORT SALES IN DESTIN, FLORIDA?

Buying and selling short sales and bank owned properties in Florida can be a very rewarding process.   Our current shift to a distressed market makes real estate agents even more valuable to buyers and sellers of distressed properties.  These types of transactions are not typical and require a high level of expertise.  One should hire a real estate agent that has the experience and training needed to successfully close one of these transactions.  I am a certified distressed property expert (CDPE) and I have also completed “Short Sales Superstars” training.    I personally endorse both of these systems and feel any Realtor would benefit from taking these courses.  I have successfully closed both short sales and bank owned (REO) properties and I have to tell you they are not your standard real estate transactions.   Below are some common issues when dealing with distressed properties.

Short Sales and Bank Owned Foreclosures (REO) – Why do you need a Real Estate Agent?

ü  What is the correct way to complete a short sale package for a short sale listing?

ü  What is the correct pricing strategy and price reduction strategy for short sale listings and REOs?

ü  When buying short sales and foreclosures, listing prices can vary.  The important factor is “value”.  A realtor can provide you with a CMA Report “Comparative Market Analysis”.  This report will show you the current value and help you make the correct offer.   There are many overpriced short sales and foreclosures.  Understanding the true value is critical and Realtors have access to superior CMA reporting through their local MLS.  This will save you money and prevent you from overpaying.

ü  What contract do I use?  In Florida, we have the FAR, FARBAR, FAR WITH AS IS ADDENDUM, FAR BAR AS IS, and the SHORT SALE ADDENDUM.  Different contracts should be used in different situations.  For example, I feel the FAR/BAR AS IS contract works best when representing buyers of distressed properties because of the inspection period language. 

ü  Who is the best property inspector for REO’s and Short Sales?  Foreclosures and Short Sales are typically sold AS/IS.  Do not let the name deceive you.  An AS/IS sale is not a bad thing.  It is critical that you have a good inspector to point out any issues with the property and have the correct inspection period language in your contract.  Also, understand that utilities may have to be turned on for the inspection and the home may have been without power for months or years.

ü  How do I negotiate with the Bank?  There are many factors to consider when negotiating with the bank.   How long has the property been on the market?  Is it a local bank or larger Bank?  Is it a short sale or a foreclosure?  What is the condition of the property?  The list goes on and on.  A "distressed property" Realtor can advise you on all of these situations.

A Realtor with distressed property experience has now become a necessity.  I encourage all buyers and sellers of Real Estate to hire a Realtor with distressed property training and experience before entering into one of these complex transactions.

Destin  Florida Foreclosures - Information for Buyers

I have been working with many buyers making offers on bank-owned-foreclosures (REOs) in Destin, Sandestin, Santa Rosa Beach, Florida and I have some information to share.

There is no set rule for what to offer on a Destin, Fl Foreclosure.  I have seen banks come down 20% and I have seen clients pay well over the asking price.  I have seen bank listings way over-priced and I have seen under-priced bank listings.  When making an offer on a bank owned property, giving the bank access to a CMA "comparative market analysis" can help.   When representing the buyer, it is not a bad idea to include comps and the MLS generated CMA report with your offer.  When you are dealing with banks, understand that they are reviewing multiple offers on multiple properties in a committee-style meeting.  Sometimes you need educate them on what their property is worth.  I recently had a situation where we placed a market value cash offer on a property and the bank would not accept it.  We then submitted the same offer with comps and a CMA and the offer was accepted.  We also included the wording "Final Offer".  I feel it was accepted because the information was at their finger tips and they were able to make a decision based on accurate information.  The offer and CMA information were emailed and all in the same PDF file.  I did it this way because the comps and CMA were printed with the offer.  This assured me that the CMA would be reviewed in their meeting.  It is very frustrating when you make a cash offer at market value and it is declined.

Some banks may not be ready to let their properties go at the current value because they may not be ready to take the loss on their books. Do not assume that just because the property is bank owned, the bank will sell at our new value.  At some point these properties will become available at market value, but not always in the beginning. 

When banks price their properties correctly, you may find yourself in a multiple offer situation.  You will typically receive a form or an email stating that "there are multiple offers on the property, please submit your highest and final offer".  In many of these situations, the sale price can exceed the listing price.  Again, this is where having a good CMA is critical.  If the property is priced below value, paying over asking is a not a bad thing.

Below is the basic definition of a Short Sale.

Short Sale - A sale of a "house in which the proceeds fall short of what the owner owes on the mortgage.   Many lenders will agree to accept the proceeds of a short sale and forgive the remaining deficiency.  In some cases, the lender may require the seller to pay a cash contribution or take on a note for a portion or all of the deficiency balance.  By accepting a short sale, the lender can avoid a lengthy and costly foreclosure, and the owner may be able to pay off the loan for less than what he owes."  

Recent issues with Bank Owned properties make short sales an even more attractive option.  In a short sale, the owner of the property agrees to the sale and signs off on the closing.  In a REO "Bank Owned" the lender acquires the property via "Hostile Take Over" and this could lead to future risk.  Never purchase any Florida property without obtaining title insurance.  This is for your protection and worth every penny. 

When purchasing a short sale, be prepared for the following:

1.  The time line from offer to closing can take up to 3 months or longer.  It is good practice to place a time line for lender acceptance in your contract.  The Florida Short Sale Addendum includes an acceptance time line.

2.  Most lenders will require the use of an "As Is" contract with an inspection period.  I prefer the FAR/BAR As Is contract.  It is easy to understand and it offers protection and flexibility to the buyer with the inspection period language.  I prefer to start all time lines upon "Lender Acceptance".  This way you do not have to invest in inspections and appraisals until you know you have a deal.

3.  Even if one makes a full price offer on a short sale, the bank may still decline the offer and refuse the short sale.  An agent with short sale experience will know what questions to ask to help increase your chances of a successful transaction.

4.  If you plan on purchasing with a financing contingency, it is important to have a pre-approval letter from your lender to submit with your offer.  If you intend to pay cash, most lenders will require proof of funds.  Proof of funds can be provided by your bank or financial institution.  A recent investment account statement will work fine.

I was working on a REO (Bank Owned) today for a client. The House we found was priced aggressively and the bank holding the property offered to finance the house. The terms were excellent and the rate was discounted. This is one of the advantages of purchasing REOs from banks. On a good scenario, one could pick up a property at a distressed price and secure discounted financing from the bank holding the property. This was very common in Destin, Forida in the 1980s and we may see more and more of this in the coming months.

Banks do not want to be in the real estate business and some are willing to offer special terms to get out. When working on an REO, be sure to inquire about any "Special Financing Opportunities". You may find the bank happy to finance their property.

DESTIN FLORIDA FORECLOSURES AND SHORT SALES - THE BASICS

A short sale is an attempt for a borrower (seller) to avoid a foreclosure by selling their property for less than the amount of the loan.  The borrower (seller) will request that the bank forgive the deficiency on the mortgage and the short sale is less damaging to the borrowers credit score than a foreclosure.  Banks are often open to this because it can cost them less money in the long run than the foreclosure process.  The borrower must show the bank that they are unable to pay their note and many banks will not even discuss the short sale until the borrower is past due. 

In a short sale, the borrower (seller) can place the property on the MLS “multiple listing service” for any price they like but that does not mean the bank will accept the offer.  The ”undervalued” short sale creates a false and deflated value and often a disappointed buyer because the bank, after their analysis, declines the offer.  If you work with agents that understand the short sale process, your chances of success will increase dramatically.  I have completed many short sales and they are some of the best buying opportunities available.  The short sale process can easily take 90 - 120 days;  therefore; a buyer needing a house today may not be a good candidate for a short sale but most importantly the bank may decline a full price offer because the seller (borrower) priced the property too low.  If a buyer has time to kill, a short sale can work, but if it seems too good to be true, it probably is.  I have seen situations where the short sale sold price “final price” is more than the actual listed price.  I think it is important for buyers to understand this process to avoid frustration and wasted efforts.  I have also seen many successful short sales take place, but they were priced correctly and it took time for the bank to review and accept the offer.  An ideal short sale situation is the “pre-approved” short sale.  The pre-approved short sale price and terms have been worked out with the bank prior to the sale and these can be done quickly.  Every bank has a different policy when it comes to short sales, therefore, the results can vary from bank to bank. 

If you are a borrower in a situation where short sale or foreclosure advice is needed, I strongly recommend that you consult with an attorney.  This will be money well spent.

On the other hand, the purchase of a REO (Real Estate Owned) property is a faster strategy.  The REO property is bank owned and past the foreclosure process.  Most REOs are priced aggressively and offer the ability of an inspection and a quick closing.  The list prices are real and one making a good offer with solid funding should be able to close the deal.  Currently there are many more short sale properties on the market than REO properties but this will change as the banks begin to hold more and more property.  REO properties are in high demand and you will likely find yourself competing with savvy investors in multiple offer situations.  A great realtor and a good strategy are needed to be succesful in the REO market.
